Methods Of Prevention And Settlement Of Labor Disputes

Labor disputes should be redressed or prevented as soon as possible. Prevention of dispute means, avoiding it from the very beginning of its occurrence, where as, settlement of dispute means, managing the existing dispute through the use of different management tools and techniques. Following are the main methods of settling disputes:

1. Collective Bargaining
It is concerned with a process of negotiation, settlement and administration of disagreement between management and workers. In collective bargaining, workers are represented by their representatives for the determination of mutually trusted terms and conditions at work. Under this method of dispute settlement, employees and management sit together to discuss about the agendas and problems of employees. Then, an agreement is reached being based upon consensus of both the involving parties to settle the existing disputes or to avoid future occurring labor disputes in the organization.

2. Grievance Handling
Employee grievance is the perception of unfair treatment at work. In every organization employees have complaint against their employers. Hence, a complaint affecting one or more employees at a time does constitute a grievance. Grievances are symptoms of conflict in an organization; hence, they need to be managed promptly and efficiently. Therefore, a proper step should be taken towards the systematic settlement of grievances in the organization.

3. Conciliation
Conciliation means settlement of dispute by persuation of third parties. In simple terms, conciliation means reconciliation of differences between individuals. It refers to a process by which the disputing parties are brought together before a third party with a view to settle the disputes through persuation. They discuss about the issues and problems and reach upon at an agreement. During discussions, the third party can only provide suggestions but cannot influence either party for the implementation if its suggestions. 

4. Mediation
It is similar to conciliation under which a third party is appointed for recommendations and suggestions. Under this process, the party plays more significant role as compared to conciliation. Here, the third party works as an arbitrator by giving a solution on a dispute while in conciliation the conciliator only facilitates the talk between disputing parties. 

5. Adjudication
It is an ultimate legal remedy of any dispute. Under this method, the disputes are settled in reference to adjudication by the government. Hence, this is regarded as a process of mandatory settlement of any dispute through adjudication with or without the consent of disputing parties.

Who Ate All The Pies? - Cyprus Cashflows Pre "Bailout"




RT reports the following:
"A company owned by in-laws of Cypriot President Nicos Anastasiades wired €21 million from Laiki Bank to London days before the Eurogroup’s crisis-triggering levy proposal, claims a Cypriot newspaper. The president demands an investigation.

During two days, 12 and 13 of March, the company A.Loutsios & Sons Ltd., co-owned by Loutsios John, the husband of Nikos Anastasiadis’ daughter, Elsa, took five promissory notes worth €21 million from Laiki Bank. The money was then transferred to London, reported Cypriot newspaper Haravgi, affiliated to the communist-rooted AKEL party.

The withdrawal was fulfilled just three days before the Eurogroup meeting when euro finance ministers agreed a 10 billion euro ($13 billion) bailout for Cyprus.

The company, however, has firmly denied the reports.

The newspaper recalls that Cyprus Finance Minister, Michalis Sarris, publicly admitted that the government was aware in advance about the Eurogroup’s intentions to impose a “haircut” on bank deposits of more than 100,000 euros.

Spokesman of AKEL, Stavros Evagorou, has called on the investigation committee to check the information regarding money withdrawal by Anastasiades’ family members as well as other reports about money transfer from the country on the eve of the Eurogroups’ levy decision.

Responding to the allegations, President Anastasiades called the publication an “attempt to defame companies or people linked to my family”.

“[This] is nothing but an attempt to distract people from the liability of those who led the country to a state of bankruptcy,” Anastasiades said.

The president stressed that no one, including himself, will walk free from the on-going investigations looking into responsibility for the crisis that has engulfed the Cypriot economy.

Moreover, Anastasiades assured that when the investigative committee assembled on Tuesday, he would request that its members look into this particular case."
In related news, Cyprus News reports that "700millions fled the country between 1-15 march 2013".

Protothema.gr reports the following:
"Four pages with the names of some 132 companies and individuals who withdrew the bulk of their deposits in euros, dollars and rubles kept in local banks reveals protothema.gr.

Transfers of money totaling causes vertigo made within 15 days, namely the period from 1st until March 15, 2013. On Friday, March 15 at the Eurogroup meeting which decided formally levy, as has been called the "haircut", on deposits of companies and individuals in all banks in Cyprus. These 132 companies and individuals seem to have "inside" information about impending single taxation of deposits in Cypriot banks so it proved as the elements contained in lists, in most cases, they withdrew all their deposits in Euro, dollars and rubles, which moved to other banks outside Cyprus, which apparently considered a "safe harbor."

The disclosure of the list, which shows that the outflow of deposits from local banks other financial institutions outside Cyprus became massively creates reasonable suspicion that some had inside information about the decisions taken by the other 16 eurozone countries in exchange for funding deficits of the economy.

Apart from the huge moral issue raised, the government of Nikos Anastasiadis is heavily exposed, since in some cases, those who took huge funds from abroad are relatives of the President of the Republic, as the company Loutsios & Sons ltd owned by father of groom Nikos Anastasiadis, who three days before the decision to "haircut" deposits transferred to a British bank 21 million euros!

Read the lists with the names of all companies and individuals who withdrew their deposits from Cyprus during the period from 1st until March 15.

The first column are names of companies and individuals in the second record of the amounts withdrawn in the third column refers to the account balance of the People, the currency in the fourth and the fifth and last column refers to the date of transfer.

Resumen pluviométrico Marzo 2013



Sin duda este mes de Marzo de 2013 ha destacado por los registros pluviométricos acumulados tanto en nuestra comarca como en el resto de Catalunya y España.

En la mayoría de observatorios se han superado los valores habituales ya de por si elevados puesto que Marzo suele ser un mes bastante lluvioso coincidiendo con el inicio de la primavera.

A continuación mostramos el mapa con las precipitaciones acumuladas en el Baix Llobregat:



Sobre este mapa podemos observar la distribución de las precipitaciones en nuestra comarca.


Las precipitaciones más importantes se han concentrado por una parte en la zona de Vallirana – Begues, debido a un temporal de Xaloc (Vientos del SE) que nos afectó a principios de mes, y por otra parte en la zona más oriental y cercana a la costa, afectada por las primeras tormentas del año.


Los registros pluviométricos más destacados en nuestra comarca han sido los siguientes:

-          Castellví de Rosanes: 152,4mm

-          Cornellà de Llobregat: 139,7mm

Comentar que gran parte de las estaciones citadas acumulan a lo largo del año en torno a los 200 mm lo que representa una tercera parte de la lluvia anual que solemos recoger en nuestra comarca, donde la media se sitúa en torno a los 600 – 650mm anuales.

Además de las cantidades recogidas en este mes de Marzo ha sido relevante la cantidad de días con precipitaciones significativas (≥ 0,2mm). En el observatorio de Sant Andreu de la Barca, se han recogido precipitaciones significativas 15 de los 31 días del mes.

吉田商事 倒産の理由

吉田商事が倒産した理由を見ると、株主総会の特別決議による会社解散ですね。吉田商事は、倒産前に事業譲渡を行っており、ミス・ユニバースの日本におけるプロモーション活動は他社が継続するのではないでしょうか。

(1)特別清算して倒産

特別清算で倒産した会社の事例を見てみると、有名企業の関連会社や子会社も株主総会の決議により会社解散をしていることがありますね。

吉田商事、倒産の理由を見ると同様に、株主総会の決議により解散していることが分かります。会社の解散は、株主総会で特別決議を行えば会社解散ができますので、出席株主の3分の2の賛成の決議により倒産を決めたのでしょう。

(2)特別清算開始決定で倒産

吉田商事 倒産の理由について2013年4月1日帝国データバンクが、「ミス・ユニバース(R)」日本大会を運営していた企業が倒産と報じているので見てみましょう
吉田商事(株)(TDB企業コード981178464、資本金1000万円、東京都新宿区新宿2-11-7、代表清算人吉田昭弘氏)は、3月21日に東京地裁より特別清算開始決定を受けた。
吉田商事倒産の理由を見ると、特別清算開始決定を受けており、資金繰り倒産や手形の不渡りではなく、自主的に倒産していることが分かります。

(3)吉田商事の業務内容

当社は、1999年(平成11年)12月にイベント・プロダクション事業を目的として設立。アイビージージャパン(株)の商号で展開し、「ミス・ユニバース(R)」日本大会の運営管理を主力に、各種イベント・パーティーなどの管理運営のほか、タレント・モデルのマネジメントを行っていた。
吉田商事は、ミス・ユニバースの日本大会の運営管理などを行っており、芸能関係の仕事が主な業務であったようですね。

(4)ミス・ユニバースの日本におけるプロモーション活動を行う

都内の弁護士法人から出資を受け、美のワールドカップともいわれるミス・ユニバースの日本におけるプロモーション活動(日本における出場者の募集、代表選考、選抜者への指導など)を主に手がけ、2009年3月期の年収入高は約2億7300万円を計上していた。
吉田商事の主な業務は、ミス・ユニバースの日本におけるプロモーション活動であり、売上高も倒産時の負債金額が3000万円であることを考えると、それなりの金額であることが分かります。

吉田商事は、弁護士法人から出資を受けているようですが、倒産の理由は特別清算ですので、何か関わっているのか気になりますね。

(5)事業譲渡を行っており、株主総会の決議で解散

こうしたなか、2012年夏にこれまで手がけていた事業を別会社に譲渡。2012年8月に現商号へ変更したうえで、2013年1月11日開催の株主総会の決議により解散していた。負債は約3000万円。
吉田商事は別会社に譲渡しており、ミス・ユニバースの日本でのプロモーション活動を続きそうですね。吉田商事、倒産の理由を見ると、管理人の私見ですが株主総会の特別決議による解散であり、計画的に事業譲渡も行っていますね。Any source

アグロ カネショウ 配当金が入金! 2013年3月


果樹や野菜向け農薬専業メーカーの「アグロ カネショウ(4955)」から、配当金が入金されました。
金額は、持ち株100株に対して、3,595円でした。

「アグロ カネショウ」は、自己資本比率が5割台で、有利子負債が14億円に対し、現金等が77億円と、財務面は非常に安定感があります。
株価については、PBRが1を大きく下回り、資産面からは割安感があります。

業績は、基本的に安定しています。
アグロ カネショウにとって外せない話題は、福島原発による影響です。
原発の避難地域内に主力工場があり閉鎖せざるをえなかったことから、茨城に新工場を建設しました。
そして、今年度は、その償却負担が大きくなったことから、減益の見込みです。
また、東京電力との賠償交渉は遅々として進まないようです。
配当利回りは3%台で、なかなか魅力的です。

このアグロ カネショウですが、実はすでに売却済みです。
理由としては、元々、5%台の配当が魅力で購入しましたが、株価高騰で配当利回りが下がってしまいました。
また、今期の業績が減益で、PERからも割安感が薄くなったことから、違う銘柄に乗り換えていまいました。
しかし、基本的には評価している銘柄なので、今後、株価が下がることがあれば、また、買いたいです。

●2013年に受け取った配当金合計 12,206円
●これまでに受け取った累計の配当金合計 249,162円

少しずつですが、資産が増えてきて、嬉しいですね。

I won’t wax lyrical  about today’s writer as it is me! My last post was about how you could improve your chances of finding a role by networking.  This post is about how you can vastly improve you ability t hire into your organisation.  (Ed Scrivener)


The Future of Recruitment?

The technophiles amongst you will not have missed the recent announcement to much fanfare of the latest phone from Samsung which will be controlled by movement of your eye.  However, what is surprising is that another device utilising the same principal has gone completely under the radar, which has the potential to revolutionise the recruitment industry and vastly improve retention rates.

The FES2 is a unique device that could have come straight from Q’s laboratory in James Bond, which measures the accuracy of candidates’ answers when interviewing.  I first came across this several months ago at a recruitment exhibition and I am aware of a number of my contemporaries that use it, however, I have struggled to find any mention of it in anything other than the most obscure trade publications.

In the short period I have been using the FES2 my accuracy in interviews has vastly improved as it easily highlights to me the questions I need to delve deeper with.  However, the real benefits will be long term as the idea of the FES2 is to ensure you’re making the right decision first time.

I appreciate I have been slightly aloof with describing it so far and that is partially because I wanted to express the benefits of it before describing exactly what it does, as this could cause potential ethical concerns.  The FES2 works on the principal of measuring eye movement during questioning and therefore candidates need to be closely scrutinised during interview via video equipment with real time results fed back to what is in essence a tablet.  The basic premise is that the movement of the eye when answering questions will indicate whether the answer is truthful or made up, or somewhere in between.  The natural response of the eye is to look to the right when recalling the truth and to the left when creating an answer – or lying!  Of course where the FES2 comes into its own is that it picks up the microscopic movements of the eye that you wouldn’t see without the aid of technology. 

I made a quip about it being used by Q, but I understand the origin of the machine was used by the military, so in essence the FES2 is an advanced interrogation device.  This in turn creates the ethical concern I alluded to earlier.  You do need to have a candidate sign a waiver before undertaking the interview, but so far less than 5% of the people I have invited to interview have declined the opportunity.  Playing Devil’s advocate you could argue that 95% of people have agreed to be interviewed in this manner due to the economic climate and the lack of opportunities, however, I feel in general this will benefit businesses immensely by ensuring they get the right hire every time – which will hugely reduce the average cost per hire.

I am conscious that this could almost be construed as an advert for the FES2 and I am very much independent of the manufacturer, however, I feel it is just too good not to shout from the roof tops about.  The creator Cal Lightman has stated he intends to develop further versions that will monitor heart rates and body temperature to truly give a fool proof system.  While this may sound like an elaborate interrogation or akin to an episode of Jeremy Kyle, I firmly believe in the long run it will truly revolutionise the way we hire talent into a business despite the potential ethical drawbacks.
